USER-GENERATED CONTENT -TERMS OF USE

We occasionally ask customers and social media users for permission to use their photos, videos, reviews, testimonials, feedback, endorsements and other multimedia (“Content”) on our promotional material, marketing, websites and social channels (“Topdeck Media”).

You agree to allow us to use your Content on Topdeck Media in accordance with these Terms of Use if you:

• reply to our request using the hashtag #yestopdeck;

• tick a box on our app or website agreeing to these Terms of Use; or

• otherwise indicate your acceptance of these Terms of Use.

LICENCE

By agreeing to these Terms of Use you grant Topdeck a worldwide, perpetual, irrevocable, royalty- free, fully-paid, non-exclusive, transferable, sub-licensable right to use your Content in any manner to be determined in our sole discretion, including but not limited to use on websites and social media, promotional emails and in any other marketing, promotional and advertising initiatives. We may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your Content in any manner in our sole discretion without obligation to you.

Where your Content includes a review, testimonial, feedback or endorsement we may publish edited or partial versions. However, we will never edit Content in such a way as to create a misleading impression of your views.

You represent and warrant that (i) you are solely responsible for your Content, (ii) you own all rights in and to your Content and/or have obtained appropriate rights and permissions from any and all other persons and/or entities who own or otherwise claim any rights in such Content, (iii) you are not a minor, (iv) our use of your Content as described herein will not violate the rights, including copyrights and moral rights, of any third party.

You release and agree to hold us harmless from any liability related in any way to our use of your Content.

Unless you have requested that we use your Content pseudonymously, you grant us the right to use your name, username, likeness, location/geotag or other identifying information in connection with your Content. By granting this licence you agree to the collection, use, disclosure, transfer and processing of your personal information in accordance with these Terms of Use and our Privacy Notice.

We may alter these Terms of Use at any time without notice. You should review the Terms of Use each time you grant permission for us to use your Content.

Topdeck means Top Deck Tours Ltd and its related companies, agents, contractors, licensees and assigns.
